As the linked trial transcript will show, a key moment in our recent jury trial win came during the cross-examination of the defendants’ expert witness.
By spending less than an hour researching their expert, we found a case in which a court had excluded his testimony.
We used this ammunition to plan a cross-examination that would challenge the defense expert’s credibility as opposed to battling with him on the nuances of his opinion, which became secondary.
And by extension we were challenging the credibility of the insurance company defendants who had called this expert to the witness stand.
Young lawyers, please note:
Winning the credibility battle is the name of the game.
The credibility game is won at trial.
It would have been a huge mistake to expose the opposing expert’s previous exclusion in a pre-trial deposition or motions.
