Carmen’s notable arbitration victories include:
- Persuading a franchisor to settle on very favorable terms on the fourth day of an arbitration hearing, after completing the cross-examination of the franchisor’s expert witness in support of its claim for damages against the franchisee, and establishing that the “expert” had failed to meet the well-known Daubert standards for the admissibility of expert opinion testimony –thus delivering a fatal blow to the franchisor’s claims in the arbitration.
- Winning 100% of the amount claimed and 100% of the client’s attorneys’ fees on behalf of the seller of a prominent Chicago area sporting goods business, where the buyer refused to pay the final balance due on the pretense of discovery discrepancies in the amount of inventory that the seller delivered – but where the buyer’s defense was exposed, an arbitration hearing that lasted three full weeks, as phony.
- Obtaining the right for the designated representative of a nationally prominent independent franchisee association to attend dinner meetings between the franchisor and its franchisee advisory council, a matter of great importance to our independent association client.
- Obtaining by settlement on the eve of the arbitration hearing substantial relief for multiple franchisee clients including new franchise agreements with more favorable terms and significant protection against claimed abuses in the pricing of necessary products resulting in millions of dollars of benefits to our clients.
As an Arbitrator, Carmen has rendered Awards in more than 20 cases and has presided over hearings lasting more than one week – and he has been recognized as one of the top arbitrators in the Chicago area.
In International Arbitration, Carmen represented a U.S. franchisor in the termination of a South American area developer and Xiaoyin Cao is becoming increasingly active in this field.
