Carmen defends franchise clients from employment law liability claims. Among the matters he has handled are:
- Successful defense of franchising company when one of its key executives was accused of sexual harassment. This sensitive case threatened substantial damage to the company, which faced pressure to “do something” about a valuable executive who asserted he was not guilty. Besides conducting the required investigation and negotiating settlement with plaintiff’s attorney, Carmen convened a meeting at the franchisor’s headquarters to explain the company’s policy on harassment. He also oversaw the updating of company’s employee manual.
- Defense of franchisee clients from Title VII discrimination claims on grounds of race, gender and orientation and from wage/hour claims brought by unit level employees including store managers.
Franchising clients face the same threat of employment law liability as any other business. The fact that Carmen understands that business gives clients a substantial advantage for a successful outcome.
When clients have had insurance coverage for employment liability, the firm has been approved by carriers as defense counsel.
