In private practice since 2001, Sarah J. Isaacson is an experienced trial and appellate lawyer with a track record of handling litigation cases from the beginning in lower court and any point throughout the appellate process. Isaacson has successfully tried and settled complex disputes in state and federal court in a variety of areas including legal and accounting malpractice, land use and zoning, franchise, dealership and distribution, commercial litigation and securities matters. Isaacson joined the firm Of Counsel in 2010.
Frequently, Isaacson negotiates settlements for franchise client disputes on a variety of issues and in many industries including franchisee rights; breach of contract, lease agreements; breach of territorial provisions; breach of the covenant to non-compete claims for a variety of franchised industries. Recently, Isaacson has successfully negotiated a settlement on behalf of franchisees engaged in a franchised lawn care business against the franchisor where franchisees were seeking a declaration of their rights under their existing franchise agreement. Isaacson has also successfully settled an arbitration case on behalf of a former franchisee on breach of contract and injunctive relief claims for purported amounts due on business note and security agreement.
Additionally, Isaacson has successfully settled a case for a franchisee regarding lease guarantee seeking monetary damages and also possession of the leased premises.
Isaacson has a track record of successfully settling franchise related disputes without having to file litigation saving clients valuable resources of time and dollars. For instance, she recently negotiated a settlement on behalf of a former franchisee in a dispute with the purchaser regarding amounts due under promissory note and escrow agreement as well as alleged claims of breach of covenant not to compete and indemnity. She has negotiated an agreement to effectively resolve disputes of a licensee against another licensee in a contiguous geographic territory over claimed breaches by sales in its exclusive protected geographic territories and also negotiated and received approval from the licensor with respect to said agreement. Additionally, she has on behalf of franchisees analyzed franchise agreements to determine if there is a possible complaint against the franchisor and draft demand letter to the franchisor.
Previously, Isaacson was a litigation attorney with a Chicago boutique litigation firm, where she was a member of trial teams that won a jury verdict of $13 million in an accounting malpractice case and successfully defended a multi-million dollar zoning challenge in a bench trial in the Circuit Court of Cook County. She also successfully represented both clients through the Illinois Supreme Court.
Isaacson has also successfully tried to jury verdict joint venture claims of the plaintiff involving the development of a stock portfolio tracking system into a website, where she obtained a liability judgement in favor of the plaintiff shareholders’ derivative claim in a parallel bench proceeding. Additionally, she was a member of the trial team that tried to jury verdict a breach of contract and breach of implied warranty claims of the plaintiff in the United States District Court for the Northern District of Illinois.
Other significant cases include the successful defense against plaintiff’s claims for breach of contract and violation of the Illinois Consumer Fraud and Deceptive Business Practices Act in a court ordered arbitration proceeding; representation of objecting neighbors to planned development and variance applications including cross-examination of applicant, alderman and city officials before the Chicago Plan Commission and Chicago Zoning Board of Appeals, and orally argued on behalf of appellants a claim for relief under quantum meruit before the Illinois Appellate Court, First District and representation of income beneficiaries of a $75 million trust fund in a state court action against other income beneficiaries and their trustees.
Isaacson received her Bachelor of Science Degree in Management from Purdue University in 1997. Isaacson received her Juris Doctor from The John Marshall Law School in 2000, where she was a Quarter Finalist in the Dean Fred F. Herzog Moot Court Competition and was a member of the Moot Court Council. She also participated in study abroad programs, including British Studies at Oxford University, Oxford, England in the summer of 1995 and Transnational Litigation & Negotiations in Dublin, Ireland in the summer of 1999.
Sarah J. Isaacson is admitted to the Illinois Bar, and to the United States Supreme Court, the United States Court of Appeals for the Seventh Circuit, and the Northern District of Illinois.
